GENERAL TERMS AND CONDITIONS

For the purposes of these General Terms and Conditions of contract, the following definitions apply:

Vendor: Marigré, owner Marina Suraci, VAT number 12203260018,
registered office in Turin Via Gaeta 18, email info@marigre.com

Privacy Code: Code regarding Personal Data protection that is governed by Legislative Decree no. 30th June 2003, no. 196 with subsequent modifications and additions;

Electronic Commerce: a particular mode of commerce, governed in Italy by the Consumer Code (Legislative Decree no. 206 of 6th September 2005) and by the E-Commerce Decree (Legislative Decree no. 70 of 9th April 2003) in which, concerning this agreement, Seller and Consumer conclude the contract remotely through the Site (without their physical, simultaneous presence) therefore delivery of products is not contextual but takes place (as in this case) through shipping by third party operators (couriers/shippers); alternatively, purchase via electronic commerce might take place at the Seller's premises.

Cart: the specific section of the Site intended for completing the Purchase Order.General Conditions:the present General Conditions of Contract, through which the Seller intends to regulate sales relationship with its customers;

Consumer: a person who enters the Site, browses on it and makes online purchases according to the envisaged procedure;

Credentials: user id and password chosen by the Consumer when registering on the Site, to be used for the purposes indicated therein;

Privacy information: privacy information drafted in compliance with no. 13 and 14 of EU Regulation 2016/679 (GDPR) and Legislative Decree 196/03 (Privacy Code) as reformed by Legislative Decree 101/2018.

Modulo di Registration Form: form available on the Site through which consumers proceed to create their own account.

Purchase Order: purchase order made by the Consumer through Site procedures;

Products: products sold through the Site under an Electronic Commerce regime;Website or Site: the website located on www.marigre.com domain;

Services: Electronic Commerce services made available to Consumers by the Seller through the Website, such as an online purchase procedure in an electronic commerce mode, an online catalog, sales promotion services, a shopping cart and all other tools that facilitate consumers’ browsing on the Site, in addition to all the services and accessories for selling Products, and any other activity carried out by the Seller through the Site;

The present General Conditions govern the general rules of Services offered by the Seller via the Website to all Consumers.
In completing the electronic purchase process, Consumers will approve these General Conditions.

In order to complete their Order, Consumers must create their own account by filling in the Registration Form and choosing their Credentials.
Once they select the product they intend to purchase, Consumers must access the Shopping Cart and follow the instructions provided therein for completing payment procedure by credit card or Paypal.

As soon payment is made Consumers will receive an e-mail confirming the receipt and acceptance of the Purchase Order by the Seller.
The purchase contract is considered concluded when the consumer receives the aforementioned e-mail.
Shipping costs will be highlighted in the Cart before completing payment procedure.

Deliveries are usually made during working hours to the address indicated by the Consumer as specified in the order confirmation email.
When delivery is made, the Consumer must check the content, indicate any irregularities and/or discrepancies compared to what he/she ordered in the transport document and/or in the delivery note.

In case of non-collection within the deadline set by the courier, the items will be returned to the Seller, who will refund the Consumer except for the shipping cost.
The Seller shall not be liable for errors of delivery due to imprecise or incomplete compilation of the purchase order by the Consumer, for damages that may have occurred to the Products after delivery to a courier that has been chosen by the consumer, or for delivery delays attributable to the courier.

The Consumer has the right to withdraw from the Purchase Order without giving any reasons within 14 days from the delivery date. If the Consumer has entrusted a person with the item(s) collection, the withdrawal deadline starts from the day of delivery to the designated person other than the courier.

To exercise the withdrawal, Consumers must communicate their decision to the e-mail address customercare@marigre.com within 14 days of receipt of the product, indicating all the data listed in Shipping and Returns. The Seller will then contact the shipper to arrange the collection as indicated in the email by Consumers, and will send them an e-mail with all necessary information.

In case of cooling-off, the Seller will reimburse the Consumer the price of the Product net of shipping costs.

The refund will be carried out with the same payment method chosen by the Consumer at the time of Purchase. The refund can be retained until the Seller receives the Product and will be refused if:
- The returned item is not intact and/or has been used;
- The tag is not attached to the garment;
- The product is damaged due to the fault of the Consumer.

The Seller ensures that the Products comply to the sales agreement under articles 129 and 130 of Italian Consumer Code (Legislative Decree 6th September 2005 no. 206).
In case of defective product under warranty, the Consumer has the right to the repair or replacement by the Seller, without incurring any cost. The consumer will have the right to a price reduction or to terminate the contract in the following cases: (a) if the replacement or repair of the product is not possible or is excessively expensive; (b) if the seller has neither repaired nor replaced the product within a reasonable period of time. To determine the amount of price reduction, Consumer’s use of the product will be taken into account. Slight defects that make repair or replacement impossible or excessively burdensome are not eligible for the termination of the contract.

Slight, unimportant differences between the Products and their correspondent images and text descriptions on the site do not constitute a lack of conformity.
The Seller is responsible when the lack of conformity occurs within two years of delivery of the Product.

Consumers will lose their warranty right if they do not report the lack of conformity to the Seller within two months from the date they discovered the defect. They must report the defected items to the email address: customercare@marigre.com.

These General Conditions, as any contract with the Consumer, are governed by Italian law, particularly Title III, Chapter I of Consumer Code (Legislative Decree 6th September 2005 no. 206) dealing with Consumers.
Except for the mandatory competence prescribed by article no. 66 bis of Consumer Code (Legislative Decree 6th September 2005 no. 206), the Court of Turin will have exclusive competence in respect of any dispute concerning the validity, interpretation and/or execution of the General Conditions or sale contracts with the Seller.

Extra-judicial dispute resolution procedures mentioned in the Consumer Code, Part V, Title II bis (Legislative Decree No. 206 of 6th September 2005) are applicable law.

SHIPMENTS

The current emergency situation from COVID-19 could lead to shipment delays.

Marigré processes orders received within 48 hours.
Shipment is made exclusively by BRT couriers, who deliver to Italy in 24/48 hours and to Europe and Great Britain in 48/72 hours.
Shipping costs are charged to the customer.

In Italia Domestic deliveries are made within 24/48 hours on working days. Cost: € 5.00.
As regards Italian islands the shipping cost is € 7.00.

Shipping throughout Italy is free for orders over € 200.

We usually ship to the following countries: France (excluding Corsica), Germany, Spain, Portugal, Austria, Belgium, Holland, Luxembourg, Great Britain, Denmark, Sweden, Slovakia and Czech Republic.
Worldwide deliveries are usually made in 48/72 hours on working days. Cost: € 15.00.

Shipping is free for orders over € 250.

Customs duties of countries outside UE shall be borne by the recipient. Customers are therefore invited to contact their National Custom Authority in advance to verify costs and any import restrictions.

RETURNS

The current emergency situation from COVID-19 could lead to delivery delays.

You have 14 days from the delivery of the parcel to make your order return request. The procedure is very simple: just send an email to customercare@marigre.com following the Return Instructions.
The product must be returned in its original condition, complete with all the labels and tags attached. Garments returned with signs of wear will be sent back to the original address.
We recommend that you reuse the same box we sent you, duly sealed before being collected.

It’s not possible to make an order return request for items included in Personalized collection.

Personalized collection items are not returnable.

Return costs are charged to the customer and will be deducted from the refund. Shipping rates remain unchanged (Italy € 5,00 - Italian islands € 7,00 - Europe and Great Britain € 15,00)

You must send an email to customercare@marigre.com indicating:

- NAME AND SURNAME;
- PHONE NUMBER
- THE IDENTIFICATION NUMBER OF YOUR ORDER;
- PICK UP ADDRESS;
- APPROXIMATE PICK UP TIME.

We will reply as soon as possible giving all the information about the courier that will collect the parcel.
Return costs are charged to the customer and will be deducted from the refund. Shipping rates remain unchanged.
Once the return is received, if it complies with the characteristics indicated above we will refund you within 48 hours except for shipping costs.

PAYMENTS

Prices shown on Marigré website are in € and include taxes and VAT, according to the current rate.

Shipping costs are charged to the customer. (Italy € 5,00 - Italian islands € 7,00 - Europe and Great Britain € 15,00).

Marigré accepts the following payment methods: Visa, Mastercard, Maestro, Paypal, Apple Pay, Google Pay, Shop Pay.

If you choose Paypal, once you select the option at “checkout” you will be redirected to Paypal site: log in, check the amount and click on “pay now”. When the transaction is carried out return to the Marigré website.

Payment must be made at the time of the order which will be processed only after receipt of the transaction.

Upon receipt of your order we will send you an email confirming your purchase with a reference number of the chosen item(s) and the total price.

Once the order has been processed, our BRT courier will send the shipment tracking number to the email address you provided in order to follow and monitor your purchase.

Categories of collected data are as follows:

- Data provided directly by the customer:data provided by the Consumer are general information entered in the Registration Form along with data relating to the payment instruments used to complete the purchase.
- Automatically collected data:certain categories of data are automatically stored such as information relating to the Consumer’s navigation on the Site. As in many other websites, when Consumers’ browser or their device access the Site, "cookies" and other unique identification tools that allow us to obtain certain types of data are used (see article 4)

The consumer’s personal data are processed for the following purposes:

- Purchase and delivery of Products.Personal data are used to receive and manage orders, supply the products, process payments and communicate with the Consumer regarding orders, products and promotional offers.
- Recommandations and personalization.Personal data are used to suggest features and products that could be of interest to consumers, identify their preferences and personalize their experience on the site.
- Advertising.Personal data are used to show the Consumer advertising defined according to the interests of the Consumer. No information that personally identifies Consumers in order to show them advertising based on their interests is used.
- Prevention of credit fraud and risks.Consumers' personal data are also processed to prevent and ascertain fraud and abuse. Credit reliability ratios may also be used to assess and manage credit risks.
- Purposes for which we ask for Consumers’ consent.The Consent of Consumers may also be requested to process their personal data for specific purposes occasionally determined. The consent they give can be revoked at any time.

Cookies, pixels and other technologies (jointly, "cookies") are used to recognize the consumers’ browser or device, discover their interests and offer functionality, products and advertising.

In particular, cookies are used to:
- Recognize consumers when logging into their account. In this way we can provide product suggestions, show them personalized content, and possibly provide other customized features and services.
- Keep track of the preferences indicated by consumers in order to propose advertising - even of other market operators – defined according to their interests.
- Keep track of items saved in the cart.
- Conduct research and analysis in order to improve the content, products and services offered on the Site.

Authorized third parties may also set cookies when the Consumer interacts with the Site. Browser cookies can be managed through the browser settings. "Help" feature present in most browsers will indicate how to prevent the browser from accepting new cookies, how to make the browser warn Consumers when they receive a new cookie and how to disable cookies and their expiration. If all cookies on the browser are disabled, neither the Seller nor third parties will transfer cookies to the Consumer browser. In this case, however, Consumers may have to manually adjust some preferences every time they visit a site and some features and services may not work.

Consumer data are not sold to third parties. However, some data are communicated to third party service providers, who can take care of certain activities on behalf of the Seller, such as fulfilling orders for products or services, delivering packages, sending paper mail and e-mail, the analysis of data, the provision of marketing consultancy, the execution of payments, the transmission of content, customer support. Third party service providers have access only to the personal data that are necessary for the performance of their activities; however, they will not be able to process the data they come into possession of for further purposes. In addition, third parties are required to process personal data they come into possession of in accordance with this Privacy Policy and applicable regulations regarding the personal data protection.

Consumers can access their data that include their name, address, payment options, profile information, settings and purchase history, at any time. Consumers can request data correction or cancellation, or the limitation of the processing of personal data concerning them, or to oppose their treatment, at any time. They also have the right to lodge a complaint with the supervisory authority on personal data.

The Seller does not sell products to minors.

Personal data are stored to allow Consumers to use the Site repeatedly and will be deleted as a result of Consumers’ requests on the matter.
